Conditions of Sale

1. The auction

These conditions govern the benefit auction Negotiating Belonging, organised by Art Initiatives, a registered association (asociación) with its seat at Carrer Salvador Dalí 1-4, 07820 Sant Antoni de Portmany, Ibiza, Spain, NIF G22903355, and held at Juntos House, Camí del Pla, s/n, 07816 Sant Mateu d’Albarca, Ibiza, on Sunday, 4 October 2026, including the online pre-bidding through this website beforehand and the post-auction sale afterwards. The seller of each work is the artist, who authorises Art Initiatives to conduct the sale in their name. Proceeds are shared between the artist and the causes described on this website: Anno’s One Fine Day Arts Centre in Kibera, Nairobi, and, for 2026, Espais de Vida in the Balearic Islands. By bidding, online or in the room, you accept these conditions.

2. Starting prices and bidding steps

Each lot is offered with a starting price, stated on its page in this catalogue. No bid below it is accepted; if no bid reaches it, the lot remains unsold. All amounts are in euros. Bids rise in fixed steps according to the current price of the lot: €50 below €1,000; €100 from €1,000; €200 from €2,000; €500 from €5,000; €1,000 from €10,000; and €2,000 from €20,000. A new bid must be at least the current price plus the step that applies to it.

3. Pre-bids placed through this website

Until the auction begins on 4 October you may place a pre-bid on any lot through its page on this website. A pre-bid is a binding, irrevocable offer to purchase that lot at the amount you enter, and cannot be withdrawn or reduced. To place one you must give your full name, postal address, email address and telephone number and accept these conditions; that identifies you as a registered bidder for the purposes of clause 6. We confirm every pre-bid by email with a reference number.

The highest pre-bid standing on a lot is shown on its page as the current price. When the auction begins, the highest standing pre-bid on each lot is the price at which that lot is opened in the room.

4. Maximum bids

With your pre-bid you may enter a maximum: the highest amount you are prepared to pay for the lot. Your maximum is never shown to anyone. If another bidder bids against you, Art Initiatives raises your bid on your behalf, one step at a time, to the lowest amount that keeps you in the lead, and never above your maximum. You are bound at whatever amount you stand at, up to your maximum, exactly as if you had entered it yourself. Once another bidder exceeds your maximum, your offer lapses and you owe nothing; we inform you by email so that you may bid again if you wish.

If a new bid is placed with a maximum equal to the maximum of the bidder currently in the lead, the earlier bid keeps the lead and the new bidder is informed at once. A bidder may raise their own bid or maximum at any time by bidding again with the same email address; the new maximum replaces the old one. Your maximum applies to online pre-bidding only. It does not limit you in the room: on 4 October you may bid beyond it in person if you choose.

5. Being outbid

Your offer lapses, and you owe nothing, as soon as a higher bid stands above it, whether from another pre-bid before the auction or from the room on the day. We inform you by email when this happens online, and after the auction if it happens in the room. Bidding again after being outbid creates a new binding offer at the new amount.

6. Bidding in the room

Bidders in the room must register before the auction begins and receive a bidder number. The auctioneer may refuse or reject a bid from anyone who has not registered; if a bid is rejected, the previous bid remains valid. Pre-bids placed through this website are incorporated into the proceedings and compete with bids from the room; the highest bid prevails. The auctioneer knocks a lot down to the highest bidder when no higher bid is made after the bid has been called three times. Acceptance of a bid obliges the bidder to buy the lot. If a lot is opened at your pre-bid and no higher bid is made in the room, the lot is knocked down to you at that price. Art Initiatives may withdraw a lot before it is offered at its reasonable discretion.

7. Purchase price and payment

The purchase price consists of the hammer price plus statutory VAT and, where applicable, costs of customs clearance. Import and export duties, if any, are borne by the buyer. The seller, being the artist, issues the invoice to the buyer; the buyer transfers the amount due to Art Initiatives (NIF G22903355), which receives it on the seller’s behalf. Payment is made in euros, in cash or by bank transfer, within 14 days of receiving the invoice. All taxes, costs and fees of the payment are borne by the buyer. We contact successful bidders by email or telephone after the auction with the invoice and payment details.

8. Collection of the work

Once payment has been received in full, Art Initiatives is authorised to release the work. We ask buyers to collect their purchases by 21 October 2026. After receipt of payment the buyer receives all necessary details from Art Initiatives, including the collection address and contact person. Packaging and shipping, if the buyer prefers them to collection, are arranged at the buyer’s sole risk and expense.

9. Late payment and cancellation

If the buyer fails to pay when due, the seller and Art Initiatives may set a grace period of 14 days and, if payment is still outstanding at its end, withdraw from the contract in whole or in part. On withdrawal, all rights of the buyer in the work lapse. The buyer remains liable for any transportation, storage and insurance costs incurred.

10. Descriptions and liability

Works are sold as described and viewed. Descriptions in this catalogue are based on information provided to Art Initiatives by the artists and are given in good faith; no liability is assumed for their accuracy or for the condition of the works. The organisers exercise due diligence in checking the information and in seeing that consigned works are transported and handled appropriately. Complaints and claims concerning the price, quality or condition of a work, or claims for damages, are to be addressed to Art Initiatives as organiser. These limitations do not apply to damage resulting from injury to life, body or health caused by a breach of duty by Art Initiatives or its representatives or agents.

11. Post-auction sale

From 4 October to 4 November 2026, works that were not sold at the auction may be bought by private sale. The post-auction sale forms part of the auction: an interested party may make an offer for a specific amount in person, by telephone or in writing, and these conditions apply to it. 12. Your details

We store the details you submit with a pre-bid, meaning your name, postal address, email address, telephone number, your bid and maximum, and the time and wording of your acceptance of these conditions, solely to process and confirm your bid, to inform you of the state of the bidding and, if you are successful, to complete the sale. We pass them on only as far as the sale requires, for example to the artist for the invoice. Questions about your data: info@art-initiatives.com.

13. Other provisions

If these conditions are made available in several languages, the English version prevails. These conditions are governed exclusively by the laws of Spain, without prejudice to mandatory consumer rights. The place of performance and jurisdiction is Ibiza.
